1. Acceptance of Terms

By downloading, installing, or using BreakFree AI ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App. These Terms apply to all users worldwide.

These Terms form a legally binding agreement between you and NovaMind Technologies ("Company," "we," "us").

2. Medical Disclaimer — Please Read Carefully

BreakFree AI is NOT a medical product. The App provides motivational support, habit tracking, and AI-powered coaching for general wellness purposes only.

• The App is not a substitute for professional medical advice, diagnosis, or treatment
• The AI coach does not provide medical, psychiatric, or psychological advice
• If you are experiencing a medical emergency, call your local emergency services immediately
• If you are struggling with severe addiction, please seek professional help from a qualified healthcare provider
• We are not responsible for any health outcomes resulting from use or non-use of the App

3. Eligibility

You must be at least 17 years old to use BreakFree AI. By using the App, you confirm that you meet this age requirement. If you are under 17, you must not use the App.

4. Account Registration

To access full features, you must create an account using a valid email address, or sign in with Apple or Google. You are responsible for:

• Keeping your account credentials confidential
• All activity that occurs under your account
• Providing accurate and current information
• Notifying us immediately of any unauthorised use of your account

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Subscriptions and Payments

Free tier: BreakFree AI offers a free tier with limited features.

BreakFree Pro subscription: Premium features require a paid subscription:

• Monthly plan — billed monthly, cancel anytime
• Annual plan — billed once per year, cancel anytime

Billing: Subscriptions are processed through Apple App Store or Google Play. Your payment method will be charged at the start of each billing period. Prices are displayed in your local currency at checkout.

Free trial: If a free trial is offered, it will be clearly stated at signup. Your subscription begins automatically after the trial unless cancelled.

Cancellation: You may cancel your subscription at any time through your Apple ID or Google Play account settings. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods except where required by law.

Restore purchases: If you reinstall the App or switch devices, use Settings > Restore Purchases to recover your subscription.

Price changes: We may change subscription prices with 30 days notice. Continued use after the notice period constitutes acceptance of the new price.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse engineer, decompile, or extract the App's source code
• Use automated tools to access or scrape the App or its AI features
• Share your account with others to circumvent subscription requirements
• Submit false, misleading, or harmful content through the AI coach
• Attempt to manipulate the AI coach to produce harmful, illegal, or abusive content
• Interfere with the App's servers or infrastructure

7. AI Coach Usage

The AI coaching feature is powered by Anthropic's Claude API. By using the AI coach, you acknowledge:

• AI responses are generated automatically and may not always be accurate or appropriate
• The AI coach is not a human therapist or medical professional
• You should not rely solely on AI coach advice for medical or mental health decisions
• Conversations with the AI coach may be reviewed to improve the service
• Do not share sensitive personal information (e.g. financial details, passwords) with the AI coach

8. User Content

You retain ownership of content you create in the App (journal entries, notes). By creating content, you grant us a limited, non-exclusive licence to store and display it to you within the App. We do not use your journal entries for marketing or share them with third parties.

9. Intellectual Property

The App, including its design, code, AI features, name "BreakFree AI," logo, and all content created by us, is owned by NovaMind Technologies and protected by applicable intellectual property laws. You may not copy, reproduce, or create derivative works from any part of the App without our written permission.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or that streaks or data will never be lost. We recommend exporting your data regularly from Settings > Export Data.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOVAMIND TECHNOLOGIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF REVENUE, OR PERSONAL INJURY, ARISING FROM YOUR USE OF THE APP.

Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless NovaMind Technologies from any claims, losses, or damages arising from your violation of these Terms or misuse of the App.

13. Termination

We may suspend or terminate your account at any time for violation of these Terms, with or without notice. You may delete your account at any time from Settings > Delete Account. Upon termination, your data will be deleted per our Privacy Policy.

14. Governing Law

These Terms are governed by the laws of India. Any disputes shall be resolved in the courts of Bengaluru, Karnataka, India. If you are an EU or UK consumer, you may also have rights under your local consumer protection laws.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 14 days before they take effect. Continued use of the App after the effective date constitutes acceptance.
